Terms of Service

EFFECTIVE May 22, 2026

These Terms govern your use of [your domain] and the services provided by ("Kim Rose Fit,"‘Kim,'‘ "we," "us," or "I"). By using the site, applying for coaching, or purchasing a service, you agree to these Terms. Please read them carefully.

1. Our services

We offer nutrition and fitness coaching, including the 3-month RŌSE Method coaching program and a one-time custom macro set. Coaching is provided on an application basis and may include custom macros, training guidance, and regular check-ins. Specific deliverables are described at the time of purchase.

2. NOT MEDICAL ADVICE — PLEASE READ Kim Rose is a Registered Nurse, and that background informs her coaching. However, our services are nutrition and fitness coaching, not medical care, diagnosis, or treatment. Information and programs we provide are for general wellness and educational purposes and are not a substitute for advice from your physician or qualified healthcare provider. Always consult your doctor before starting any nutrition or exercise program, especially if you are pregnant, postpartum, nursing, or have any medical condition. Never disregard or delay professional medical advice because of something provided through our coaching. If you experience a medical emergency, call your local emergency number.

3. Health screening & honesty

To coach you safely, we rely on the information you provide. You agree to give accurate, complete information about your health, history, and circumstances, and to update us if things change. We may decline to begin or continue coaching, or refer you to a medical provider, if we believe it's in your interest.

4. Assumption of risk

Physical exercise and dietary changes carry inherent risks, including injury or aggravation of pre-existing conditions. By participating, you acknowledge these risks and agree that you take part voluntarily and at your own risk. You are responsible for exercising within your own limits and stopping if you feel unwell.

5. Payment

Prices are listed at the point of sale or provided during the application process. Payment is due as agreed before services begin. Payments are processed by Stripe and/or Squarespace; by paying, you also agree to their terms. 

6. Refunds & cancellation

All sales are final. Because every program involves significant custom work, your intake review, assessment, and a personalized macro and training build, that work begins as soon as you enroll. For that reason, all fees are non-refundable, including for the 3-Month RŌSE Method coaching and the One-Time Macro Set, once payment is made and work has begun. This applies whether or not you complete the program, use all your check-ins, or follow the guidance provided.

One-Time Macro Set. This is a custom deliverable produced specifically for you. Once you submit your intake and/or your macros have been built, the purchase is non-refundable.

3-Month Coaching — how to discontinue. Coaching is a 3-month at a time commitment. You may choose to stop participating at any time, but doing so does not entitle you to a refund of fees already paid, and any remaining check-ins or sessions are forfeited. To discontinue, simply email me at kim@kimrosefit.com and I'll confirm your cancellation.If you are on a monthly payment plan: You remain responsible for the full 3-month fee; cancelling stops future scheduled payments only after the current billing period, and amounts already paid are non-refundable.

At my discretion. Nothing here prevents me from offering a partial credit or accommodation in genuine, exceptional circumstances, but any such gesture is goodwill, not an obligation, and does not change this policy.

Chargebacks. If you have a billing concern, contact me first and I'll work to resolve it. Initiating a chargeback or payment dispute without first contacting me is a violation of these Terms.

7. Your responsibilities

  • Follow guidance at your own discretion and within your own limits.

  • Keep your login/password for any private client pages confidential.

  • Use the services for your own personal, non-commercial use.

8. Intellectual property

All content, programs, materials, and the RŌSE Method framework provided through our services are owned by us and provided for your personal use only. You may not copy, resell, redistribute, or share them without our written permission.

9. Limitation of liability

To the fullest extent permitted by law, [LEGAL BUSINESS NAME] is not liable for any indirect, incidental, or consequential damages arising from your use of the site or services. Our total liability for any claim is limited to the amount you paid us for the service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

10. Termination

We may suspend or end services if these Terms are violated or if continuing would be inappropriate or unsafe. You may stop using the services at any time, subject to the payment and refund terms above.

11. Governing law

These Terms are governed by the laws of the State of Kentucky, without regard to conflict-of-law rules. Any disputes will be handled in the courts located in Kentucky/Madison County.

12. Changes & contact
